Samsung finally gets cut a little slack in the Netherlands, where a Dutch court has ruled in favor of Samsung — you read that right, Samsung — in a dispute with Apple over 3G patents. The description for Samsung patent #EP1188269 describes an “apparatus for encoding a transport format combination indicator for a communications system.” I haven’t the slightest clue what all that means, but it sounds pretty general. Apparently, the patent was descriptive enough for a District Court in Holland to find Apple in violation, specifically, with their 1st and 2nd gen iPads, iPhone 3G, 3GS and 4.
If you were hoping this would mean an all out ban on Apple’s products in the Netherlands, I hate to rain on your sick little parade (okay, I was secretly hoping for the same), but being that the whole dispute was over a FRAND patent, Apple can continue selling their products as usual. But make no mistake, they will forced into forking over an “adequate” sum of cash in compensation.
