German court sides with Samsung, will not ban Galaxy Tab 10.1N
After a preliminary hearing in which a German judge seemed to lean in Samsung favor, a final verdict has been handed down. The Dusseldorf court sees “clear differences” between the Samsung Galaxy Tab 10.1N and Apple’s iPad will not enforce a ban on the device. The tablet was in court after Apple claimed that Samsung did not do enough to avoid infringing upon the Cupertino-based tech giant’s intellectual property. The original Galaxy Tab 10.1 was banned in Germany and Samsung has been fighting ever since to get some version of their flagship tablet out to consumers in the country.
The latest verdict should be the final decision in Apple’s case against Samsung’s tablet, but it isn’t the end of litigation between the two. Samsung has fought back with a few claims of patent infringement of their own. In two instances the German justice system has ruled in Apple’s favor. A third case is set to go in front of a Mannheim judge in March.
